Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions ("GTC") apply to the use of the firmafind API and all related services (collectively, the "Service") operated by Paul Lotz, Breitenseer Straße 76/1/22, 1140 Vienna, Austria ("firmafind").

They apply to all current and future contractual relationships concerning the Service, unless otherwise agreed in writing.

2. B2B only

The Service is intended exclusively for businesses, entrepreneurs, freelancers, and legal entities acting in the course of their commercial or professional activity.

By registering an account, placing an order, or using the Service, the user confirms that it is acting in such capacity. Consumer protection provisions applicable only to consumers do not apply where legally excluded for business users.

Deviating or supplementary terms of the user shall not apply unless expressly accepted by firmafind in writing.

3. Service description

firmafind provides a REST API that enables access to certain publicly available company register data from Austria and the Czech Republic, together with related service features.

Depending on the selected plan and technical availability, the Service may include in particular:

  • Company search functions
  • Retrieval of company details
  • Access to and download of certain register documents in PDF or XML format
  • Monitoring functions and change notifications

The exact scope of functions depends on the selected subscription, technical availability, and the availability of external data sources.

4. Registration and account

Registration is required to use the Service. Users must provide complete and accurate information during registration and keep such information up to date.

The user is responsible for all activities carried out through its account, unless such activities are demonstrably attributable to firmafind.

Access credentials must be kept confidential and protected against unauthorized access. If the user becomes aware of unauthorized use or a suspected security incident, firmafind must be informed without undue delay.

firmafind may refuse registrations or suspend accounts where there is a reasonable suspicion of abuse, fraud, security risks, or material violations of these GTC.

5. API keys

Users may generate API keys through the dashboard for access to the Service.

API keys are confidential authentication credentials. The user must store them securely, protect them against access by unauthorized persons, and rotate them immediately if compromise is suspected.

The user is responsible for all requests made using its API keys until the relevant key is revoked or replaced.

firmafind may revoke or temporarily disable API keys without prior notice where this is reasonably necessary to prevent abuse, security incidents, technical disruption, or unlawful use.

6. Subscription plans, credits, and billing

firmafind offers credit-based plans. Monthly or yearly fees are charged in exchange for a specified number of credits for the relevant billing period.

Monthly subscription credits expire at the end of each billing period. Purchased prepaid overage credits never expire and remain in your account indefinitely until consumed.

Unless otherwise stated on the pricing page, current indicative plan structure is as follows:

  • Free tier: 50 credits per month.
  • Trial: one-time 7-day trial with 500 total credits.
  • Starter: 2,000 credits per month.
  • Pro: 10,000 credits per month.
  • Business: 50,000 credits per month.

Unless otherwise stated on the pricing page:

  • Document downloads (PDF/XML) consume 10 credits per request.
  • Other API requests, including search and detail requests, consume 1 credit per request.

Fees are billed in advance for the respective billing period. Payments are processed via Stripe or another payment provider indicated during checkout.

Paid subscriptions renew automatically for the same billing cycle unless cancelled before the renewal date. A cancellation takes effect at the end of the current paid billing period unless mandatory law requires otherwise.

If payment cannot be collected, firmafind may suspend or restrict access to the Service until outstanding amounts are settled.

7. Changes to the Service and pricing

firmafind may develop, adapt, expand, limit, or discontinue parts of the Service where this is justified by technical, operational, legal, security, or economic reasons.

If a change materially reduces core paid functionality, firmafind will provide prior notice by email where reasonably possible. The user may terminate the affected paid subscription with effect from the date the change takes effect. In that case, any prepaid fees relating to the unused remainder of the billing period will be refunded on a pro-rata basis.

Immediate changes without prior notice remain permissible where necessary to address abuse, security risks, legal requirements, or changes imposed by external data sources or official registers.

firmafind may change prices for future billing periods by giving prior notice in an appropriate form. The changed prices apply only from the next renewal date. If the user does not agree, the subscription may be cancelled before renewal.

8. Rate limits and fair use

Use of the Service is subject to technical rate limits and other usage controls designed to protect system stability, security, and fair access.

Applicable limits may depend on the user’s plan, credits, endpoint type, and technical setup. Current rate limit information may be communicated in the dashboard, documentation, pricing page, or API headers.

Exceeding rate limits may result in throttling, temporary blocking, or error responses, including HTTP status code 429.

Adhering to technical rate limits and usage controls is required. Users may not circumvent rate limits or usage restrictions by creating multiple accounts, rotating IP addresses, using proxy networks, or employing comparable methods.

9. Permitted and prohibited use

The Service may only be used for lawful business purposes.

Permitted uses include, for example:

  • integrating company data into internal systems, CRMs, or workflows
  • supporting internal compliance, verification, or due diligence processes
  • building applications that display or process company records within the permitted scope of use

The following uses are prohibited unless expressly agreed in writing:

  • violating applicable law or third-party rights
  • interfering with or attempting to bypass security or rate-limiting mechanisms
  • conducting denial-of-service attacks or other activities causing technical disruptions
  • systematic or automated bulk extraction of substantial parts of the dataset in a manner that impacts system stability
  • reselling, sublicensing, or commercially redistributing raw API responses as a standalone raw data service
  • using the Service for spam, phishing, fraud, or deceptive practices
  • any use that imposes an unreasonable technical burden on the infrastructure

For the avoidance of doubt, the Service may not be used to operate a standalone commercial substitute API or raw data product that replicates the core API functionality of the Service for third parties.

firmafind may investigate suspected violations and suspend or terminate access where reasonably necessary to protect the Service, other users, or legal interests.

10. External data sources and data quality

The Service relies in whole or in part on external sources, including official or public company register sources.

firmafind does not control such external data sources and does not guarantee that data obtained through the Service is accurate, complete, current, uninterrupted, or fit for a particular purpose.

Register data and related content are provided on an "as is" and "as available" basis, subject to mandatory law.

The user remains responsible for verifying data where required for legal, financial, compliance, or operational decisions.

11. Data protection

The Service may contain publicly available company-related information from external registers. Depending on the specific record, this may also include personal data contained in public filings or registers.

Each user is solely responsible for ensuring that its own collection, storage, combination, use, disclosure, and other processing of data obtained through the Service complies with applicable data protection and other laws.

12. Availability, maintenance, and support

firmafind aims to provide a reliable Service but does not guarantee uninterrupted availability.

Temporary interruptions may occur, in particular due to maintenance, security measures, technical faults, capacity issues, force majeure, failures of telecommunications networks, or outages or changes affecting external data sources.

Planned maintenance will be announced in advance where reasonably possible.

13. Suspension and termination

The user may cancel a paid subscription at any time through the dashboard. Unless otherwise stated, cancellation takes effect at the end of the current billing period.

The user may stop using the Service at any time. Account deletion may be requested through the dashboard or support channel, subject to the settlement of outstanding amounts and legal retention obligations.

firmafind may suspend access immediately where reasonably necessary in the event of security concerns, payment default, abuse, suspected fraud, legal violations, or material breaches of these GTC.

firmafind may terminate the contractual relationship for cause with immediate effect where continuation of the contractual relationship is unreasonable, in particular in the event of repeated or serious breaches of these GTC.

Unless mandatory law requires otherwise, no refund is owed for periods in which access was suspended or terminated due to the user’s material breach.

Acceptable Use Policy

The firmafind API provides programmatic access to certain publicly available company register data from Austria and the Czech Republic. Use of the Service is subject to the following Acceptable Use Policy.

1. Permitted Use

The user may use the Service for lawful business purposes in accordance with these GTC.

Permitted use includes, for example:

  • integrating company records or selected data points into internal applications, CRMs, or business workflows;
  • using the Service for compliance checks, KYC, onboarding, and due diligence;
  • building products or applications that query the API to display or process records for the user's end-users, provided this does not constitute raw redistribution of the API.

2. Prohibited Use

To ensure the stability and availability of the Service for all users, the following activities are prohibited unless expressly agreed in writing:

  • bulk downloading or systematic automated extraction of substantial parts of the dataset in a manner that compromises system stability;
  • commercially reselling or redistributing the raw API responses as a standalone competing API or raw data product;
  • circumventing rate limits, technical access controls, or billing mechanisms;
  • using the Service for unlawful purposes, deceptive practices, or activities that impose an unreasonable technical load on the infrastructure.

3. Enforcement and Collaboration

firmafind prioritizes stable service delivery. If a violation of this Acceptable Use Policy is suspected, we will endeavor to contact the user to clarify the situation and find a mutually agreeable solution.

In case of acute security risks, technical disruption, or clear commercial abuse, firmafind reserves the right to take proportionate measures, such as:

  • temporarily throttling request rates,
  • suspending API access,
  • or revoking affected API keys.

Access will be restored as soon as the issue is resolved or clarified. In case of persistent, unrectified material breaches, further contractual remedies under Section 13 apply.

5. Use Cases and Bulk Access

If the user requires bulk access or another use case beyond the standard permitted use, a separate written agreement is required.
